Heard learned counsel for the petitioner, learned Government Pleader for Revenue for respondents 1, 3 to 5 and Sri Y.Rama Rao, learned Standing counsel for respondent No.2. 2.

Petitioner claims to be the absolute owner and in possession of land to an extent of Ac.9-00 guntas in Sy.No.57/A, Sarlaravulapally, Guttala Gadda Thanda, Kandukur Mandal, Ranga Reddy District. Petitioner alleges that some third parties have applied for conversion of agricultural land for nonagricultural purpose surrounding the land of petitioner and in the said application, the land of petitioner is also included and the same is illegal. Having come to know that some illegal sale deeds were secured, fake pass books and General Power of Attorney were obtained to grab the valuable agricultural land of petitioner, he instituted O.S.Nos.1913, 1914 & 1915 of 2015 on the file of IX Additional Junior Civil Judge, Ranga Reddy. Petitioner claims to have filed I.A.Nos.1916/2017, 1918/2017 and 1920/2017 in the said suits, praying to grant injunction order and accordingly injunction was granted. However, no material is placed on record to show that injunction orders are granted by the court below.

In this writ petition, petitioner seeks an omnibus relief not to grant lay out or LRS Proceedings to third parties without the consent of pattadars and claims to have submitted representation on 11.03.2019. But the same is not acted upon.

As is noted from Paragraph No.8 of the affidavit filed in support of the writ petition, a civil litigation is pending on the allegation of obtaining illegal sale deeds, fake pass books and General Power of attorney. In other words, petitioner is now seeking declaration against granting of conversion of lay out based on the claim of third parties who are not parties to this writ petition and against whom petitioner claims to have instituted three suits. This Court is not inclined to entertain writ petition at this stage.

Accordingly, the Writ Petition is dismissed leaving it open to the petitioner to prosecute the pending suits. Pending miscellaneous petitions, if any, shall stand closed. __________________ P.NAVEEN RAO,J 4th July, 2019 Rds
