THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO AND THE HON'BLE MRS. JUSTICE ANIS WRIT PETITIONS No. 21073 & 21289 OF 2004 COMMON ORDER: (per Hon'ble Sri Justice Nooty Ramamohana Rao) These Writ Petitions are preferred by the Deputy Commissioner of Commercial Taxes, Warangal Division and others calling in question the correctness of the order passed by the Andhra Pradesh Administrative Tribunal in O.A.Nos. 2125, 2121 of 2003 and batch of cases.
The Andhra Pradesh Administrative Tribunal, by its impugned order, disposed of the said O.As., on the basis that the lis is covered by the orders passed by the said Tribunal in O.A.No. 11575 of 2002 dated 22.01.2003.
Learned Government Pleader for Services (Telangana) has rightly pointed out that the State Government called in question the correctness of the orders passed by the Andhra Pradesh Administrative Tribunal in O.A.No. 11575 of 2002 by preferring Writ Petition No. 22924 of 2003. That Writ Petition has been allowed by this Court on 19.09.2014. It therefore, follows that the reliance placed and the basis for disposal of the present O.A. Nos. 2125 and 2121 of 2003 is knocked down by the order passed by this Court in Writ Petition No. 22924 of 2003.
In that view of the matter, these Writ Petitions are required to be allowed and accordingly, they are allowed. No costs. Consequently, the miscellaneous applications, if any shall also stand disposed of.
