HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3970 of 2018 ORDER:

This Criminal Petition is filed by the petitioner/accused under Section 482 Cr.P.C, seeking to quash the proceedings against him in Crime No. 359 of 2017 of Golconda Police Station, registered for the offences under Sections 354, 324 & 506 r/w 34 IPC.

The investigation is reported to be pending.

Having perused the complaint allegations and having been informed by the Additional Public Prosecutor that the investigation is at the nascent stage, it is not apt to stifle the investigation. Therefore, investigation shall lead to its logical conclusion. However, having regard to the fact that the dispute between the de-facto complainant and the petitioner/ accused is a matrimonial one, the Investigating Officer shall strictly follow the guidelines rendered by the Hon'ble Apex Court in Arnesh Kumar V. State of Bihar1 and follow the procedure contemplated under Section 41-A Cr.P.C., during the course of investigation. Petitioner/accused is directed to cooperate with the investigating agency for smooth completion of investigation.
