IN THE HIGH COURT OF JUDICATURE AT HYDERABAD

FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH * * * WRIT PETITION No. 26721 of 2015 BETWEEN M.Abdul Rasool ... PETITIONER AND The State of Andhra Pradesh, Rep. by its Principal Secretary, Revenue Department and others ...RESPONDENTS Date of Order pronounced: 31.08.2015 SUBMITTED FOR APPROVAL:

THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR

1. Whether Reporters of Local newspapers Yes/No may be allowed to see the Judgments?

2. Whether the copies of judgment may be Yes/No marked to Law Reporters/Journals?

3. Whether his Lordship wish to see the Yes/No fair copy of the Judgment?

ORDER:-

Heard.

2. The grievance of the petitioner is that his appeal pending before the third respondent in file No.D2/4321/2014 is not being heard and disposed of. Petitioner had produced the proceedings of the Revenue Divisional Officer (RDO) dated 17.07.2014 calling for report from the fourth respondent to enable consideration of petitioner's appeal. According to the petitioner, no such report is submitted by the fourth respondent in spite of directions of the third respondent.

3. Instructions of the learned government pleader received from the third respondent also do not refer to any such report and, on the contrary, he states that soon after the Tahisldar submits the report, necessary action will be taken on the petitioner's appeal.

4. It is evident from the proceedings dated 17.07.2014, referred to above, that more than a year had passed and there is no reason why the fourth respondent should take so much time to submit a report to the third respondent and thereby hearing and disposal of the appeal filed by the petitioner before the third respondent is held up.

5. In the circumstances, the writ petition is disposed of directing the fourth respondent to submit necessary report before the third respondent within two weeks from today, if not already submitted, and on receipt of the report, the third respondent shall fix a date for hearing of the appeal of the petitioner and after notice to all the affected parties, shall hear and dispose of the appeal, on merits, expeditiously.

As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
