THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.3395 of 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Criminal Procedure Code by the petitioner/Accused in COR No.9/2022 of Prohibition and Excise Police Station, Suryapet, registered for the offences punishable under Sections 22 (b) (ii) (B) of NDPS Act, 1985.

Briefly stated, the case of the Prosecution is that the on 31.01.2022, the prohibition and excise Sub-Inspector caught the petitioner who is in possession of 10.85 Kgs of dry Ganja. The quantity of contraband seized is less than the commercial quantity and the petitioner is in jail since 31.01.2022.

The learned Assistant Public Prosecutor submits that there are no other criminal cases pending against the petitioner.

In the said circumstances, the prayer for bail to the petitioner/accused can be granted on the following conditions.

i. the petitioner/Accused is directed to be released on bail on his executing personal bonds for Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties each for a likesum, among which one is local surety, to the satisfaction of I Additional District and Sessions Judge at Nalgonda, Nalgonda District. ii. After release on bail, the petitioner/Accused shall appear before the concerned police station, on every Monday between 10.00 A.M to 05.00 P.M, for a period of three months or until filing of charge sheet, whichever is earlier.

iii. The petitioner/accused shall comply with the conditions as laid down under Section 437 (3) of Cr.P.C.
