HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT APEAL No. 492 OF 2015 16-06-2015 Between:

Bezawada Raju ... Appellant And The Chairman and Managing Director, Southern Power Distribution and Company of TG Ltd., Hyderabad and two others ... Respondents

HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT

WRIT APEAL No. 492 OF 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) This writ appeal is directed against the following order dated 21-04-2015 passed on WPMP No. 15317 of 2015 in Writ Petition No. 11544 of 2015: "There shall be interim direction to the respondents to restore the power supply on condition of the petitioner paying 50% of the dues, as assessed by the respondents, within a period of six weeks from the date of receipt of copy of this order.

Notice."

The order under challenge, in our opinion, does not deserve any interference by this Court in intra Court appeal. However, having regard to over all facts and circumstances of the case, we are prepared to grant some more time to the appellant to deposit the amount as per the impugned order. Hence, we pass the following order:

"The appellant to deposit 25% i.e., 50% of the 50%, as per the impugned order within a period of four weeks from today and remaining 50% within a period of four weeks therefrom. It is needless to mention that on deposit of the first instalment of 25%, the 2nd respondent shall restore the electricity supply." With these observations, the writ appeal is disposed of. Miscellaneous petitions, if any, also stand disposed of.
