O R D E R
(Per Hon'ble Sri Justice Sanjay Kumar) The prayer of the petitioner in this case is as under: 'It is prayed that this Hon'ble Court may be pleased to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the 1st respondent in not considering the representation of the petitioner dated 04.10.2017 for release of her husband i.e., K.Gangi Reddy from Central Prison, Kadapa detained in pursuance of the order passed by the 2nd respondent in reference C1/9/M/2017 dated 20.01.2017 as illegal, arbitrary and consequently direct the 1st respondent to release the detenue i.e., K.Gangi Reddy for a temporary period and pass such other or further orders as the Hon'ble Court feels deem fit and proper in the facts and circumstances of the case.'
Learned Government Pleader for Home, State of Andhra Pradesh, placed before us a copy of the Memo dated 10.10.2017 issued by the Chief Secretary to the Government, Government of Andhra Pradesh, granting parole to the petitioner's husband for half a day subject to conditions.
As the Government has already exercised power under Section 15 of the Andhra Pradesh Prevention of Dangerous Activities of Bootleggers, Dacoits, Drug Offenders, Goondas, Immoral Traffic Offenders and Land Grabbers Act 1986, in response to the representation dated 04.10.2017 made by the petitioner, the cause in this writ petition no longer survives for adjudication on merits.
The writ petition is accordingly dismissed.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
