Heard the learned counsel for petitioner and the learned Standing Counsel for respondents 1 and 2.

This writ petition is filed seeking to issue a writ of Mandamus declaring the action of the respondents in not considering the representation of the petitioner dated 16.04.2016, as arbitrary, illegal and violation of principles of natural justice and also violative of Articles 14 and 21 of the Constitution of India and consequently direct the respondents to consider the representation of the petitioner dated 16.04.2016 for regularization of his services in the third respondent bank.

The learned counsel for the petitioner submits that the petitioner was appointed as a Messenger in the District Cooperative Central Bank Limited, Srikakulam, vide proceedings in Rc.No.5/Estt/F5/2013-14, dated 01.06.2013. The petitioner submitted a representation dated 16.04.2016 to the respondents seeking regularization of his services. He is being paid salary of Rs.280/- per day, which is not sufficient to maintain his family. There are regular vacancies available in the bank at present and the petitioner requested the respondents to regularize his services.

In view of the submissions made by the learned counsel for the petitioner, the respondents are directed to consider and dispose of the representation of the petitioner dated 16.04.2016 seeking regularization of his services as per rules, within a period of four weeks from the date of receipt of a copy of this order.

5. The writ petition is, accordingly, disposed of at the stage of admission. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
