THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.8716 OF 2017 ORDER:

This petition is filed by the petitioners-A1 and A2 under Section 482 Cr.P.C. to quash the proceedings in C.C.No.670 of 2015 on the file of the I Addl. Chief Metropolitan Magistrate, Visakhapatnam, which took cognizance of the offences punishable under Sections and r/w 34 IPC.

Heard the learned counsel for the petitioners, the learned Public Prosecutor representing the State and perused the record.

It is brought to the notice of this Court that charges are not yet framed. The petitioners can agitate that there is no material to frame charges and proceed with the case before the trial Court. In such event, the trial Court may pass appropriate orders in accordance with law. 4.

With this observation, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
