HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 32946 of 2014 Order:

This Writ Petition was filed challenging the action of the respondents 1 to 5 in not registering the report dated 15.10.2014 sent by the petitioner society against the 6th respondent. Today, when the matter is taken up for consideration, learned Government Pleader for Home, on the basis of written instructions, submits that based on the complaint of the petitioner society a case in Crime No.420 of 2014, under Section 447 IPC, was registered on 09.11.2014 against the 6th respondent and took up investigation. During the course of investigation, though a notice under Section 91/160 Cr.P.C was served to the complainant requesting to appear before the Investigating Officer with necessary documents, they did not turn up and no independent witness also came forward to speak anything about the alleged incident.

After obtaining permission from the Assistant Commissioner of Police, Kachiguda division dated 02.07.2015, a final report referring the case as "lack of evidence" was filed before the Additional Chief Metropolitan Magistrate, Hyderabad, at Nampally after issuing notice to the complainant.

In view of the same, no further orders are necessary in the present Writ petition and the Writ Petition is, accordingly, closed. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
