THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL PETITION No.8248 of 2015 ORDER:

The present criminal petition came to be filed under Section 482 Cr.P.C. seeking quashing of proceedings in C.C.No.419 of 2015 on the file of Judicial Magistrate of First Class (Excise), Kadapa, Kadapa District. A charge sheet came to be filed for the offences punishable under Sections 498-A, 506, 384, 312 IPC and Sections 3 and 4 of Dowry Prohibition Act. Though various grounds are raised in the present petition, learned counsel for the petitioners restricts his prayer seeking a direction to dispense with the presence of petitioners 2 to 7 before the trial Court, as there is no dispute with regard to their identity. Learned counsel for the respondents submits that their presence may be dispensed with provided they will not raise any dispute with regard to identity during the course of trial.

Having regard to the circumstances stated above, the present Criminal Petition is disposed of dispensing with the presence of petitioners 2 to 7 in C.C.No.419 of 2015 on the file of Judicial Magistrate of First Class (Excise), Kadapa, Kadapa District, on every date of adjournment except on the dates when their presence is specifically required by the Court. It is made clear that A-1 will appear on every date of adjournment.

Consequently, miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed.
