THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.20431 of 2017 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader.

The petitioner is a resident of T.Kodur Village and belongs to Scheduled Caste community. She is working as the President of Dwakra Group. While so, the dealer of fair price shop No.28 expired and the second respondent has not appointed any permanent dealer. The petitioner was appointed as a temporary dealer by the Revenue Divisional Officer by proceedings dated 07.06.2014.

The fourth respondent submitted an application to the second respondent to appoint him as a dealer in respect of the said shop on the ground that he was the successor of late Obulesu, who was the fair price shop dealer of the same Village, and he is entitled to be appointed in terms of G.O.Ms.No.4, dated 28.02.2014. On the said application, the authorization issued to the petitioner was cancelled on 24.04.2017 and the fourth respondent was appointed. The petitioner submitted an appeal to the second respondent, and when the same was not disposed of, the present Writ Petition is filed challenging the appointment of the fourth respondent.

Since the regular appeal is pending before the second respondent, this Court is not inclined to entertain the present

Writ Petition, but directs the second respondent to consider the appeal filed by the petitioner challenging the cancellation of fair price shop authorization of the petitioner on 24.04.2017, within a period of three months from the date of receipt of a copy of this order, after giving due notice to the petitioner and the fourth respondent, and pass appropriate orders in accordance with law.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 27.06.2017 vs
