THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26753 of 2017 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for the respondents.

The petitioner was appointed as a permanent fair price shop dealer of Shop No.9, Pinnapuram Village, Panyam Mandal, Kurnool District, vide proceedings, dated 10.04.2010, by the 3rd respondent. The authorization of the petitioner is valid upto 31.03.2018. While so, on the report submitted by the 4th respondent on 24.05.2017, proceedings under Section 6-A of the Essential Commodities Act, 1955, were taken on the petitioner and the same are pending. Simultaneously, the authorization of the petitioner was suspended pending enquiry on 30.05.2017. The present writ petition is filed when no other proceedings are taken for completion of the enquiry. 3.

Learned Government Pleader, on instructions, submits that a show cause notice was issued on 28.06.2017 and the proceedings are being taken up.

In view of the pendency of the proceedings before the 3rd respondent, this Court is not inclined to entertain the present writ petition, but directs the 3rd respondent to complete the enquiry within a period of three (3) months from the date of receipt of a copy of this order. It is needless to observe that the petitioner shall co-operate and the respondents shall follow due process of law during the course of proceedings.
