HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No. 12529 OF 2018 ORDER:

This Writ Petition is filed seeking writ of mandamus declaring the action of the 1st respondent in passing the order vide Lr.No.666/O/V/T-1680/861, dated 05.02.2018 by confirming the show-cause notice issued by the 1st respondent dated 04.10.2017 by compulsory retirement of service of the petitioner without considering his plea as illegal and arbitrary and consequently to set aside the same.

Heard learned counsel for the petitioner and Sri K.Lakshmi Narasaiah, learned counsel for respondents. Admittedly, appeal filed by the petitioner vide letter dated 10.06.2017 has already been disposed of by the Appellate Authority vide order dated 04.10.2017 and the same was informed to the petitioner on his application vide proceedings dated 05.01.2018.

A perusal of the impugned proceedings dated 05.02.2018 goes to show that the petitioner was suggested to prefer review within six months before the Reviewing Authority-General Manager (HR) through an application for reviewing the punishment imposed on the petitioner as provided in ABOE (D & A) Regulations.

The petitioner, instead of availing alternate remedy of filing review before the Reviewing Authority-General Manger (HR), as per the ABOE (D & A) Regulations, he has straight away filed the

present writ petition against impugned order. Learned counsel for the petitioner could not dispute the aforesaid fact. In view of the same, this Writ Petition is disposed of granting liberty to the petitioner to avail alternate remedy of review, as suggested in the impugned proceedings. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
