THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.16653 OF 2016 ORDER:

The suspension pending enquiry in Rc.No.1281/2016 C dated 11.05.2016 passed by the 3rd respondent is challenged in this writ petition.

Heard learned counsel for the petitioner and learned Government pleader.

One of the contentions which the learned counsel for the petitioner passionately and vehemently submitted before this Court is that on 27.04.2016 a show cause notice was issued to the petitioner calling his explanation as to why his fair price shop authorization shall not be cancelled and fixed the date of hearing as 02.05.2016. With respect to the charges framed against the petitioner, particularly the variation found during the inspection of the Tahsildar, enquiry was not conducted on 02.05.2016 and the same was adjourned to 16.05.2016. But till date no enquiry has been conducted and with a mala fide intention, before conducting enquiry on 11.05.2016 suspension order was passed against the petitioner. This Court on 26.05.2016 ordered notice before admission and suspended the suspension order dated 11.05.2016 till 30.06.2016.

In the facts of the present case, in as much as, a show cause notice has been issued against the petitioner, no useful purpose would be served keeping the writ petition pending. Learned counsel for the petitioner submitted that pursuant to the show cause notice dated 27.04.2016 a detailed explanation has been submitted by the petitioner. Considering this aspect, the 3rd respondent is directed to complete the enquiry after considering the explanation submitted by the petitioner and considering the fact that on 26.05.

passes the order after conducting enquiry.

With the above directions, the writ petition is disposed of. No order as to costs.

Miscellaneous petitions pending in the writ petition, if any, shall stand closed.
