THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.13262 OF 2019 O R D E R :

This writ petition is filed challenging the action of the respondent No.3 in not registering a case against respondents 4 to 15 basing on the complaints made by the petitioner dt.12.11.2018, 29.03.2019 and 16.04.2019.

Learned Assistant Government Pleader for Home submits that it is an internal dispute between the flat owners.

Learned counsel for the petitioner submits that when the allegations in the complaint of the petitioner discloses that it is a cognizable offence, the respondent police are bound to register a case in terms of the Judgment in Lalita Kumari v. Government of Uttar Pradesh (2014) 2 SCC 1.

Having regard to the facts and circumstances, the writ petition is disposed of directing the 3rd respondent to take appropriate action on the complaints of the petitioner dt.12.11.2018, 29.03.2019 and 16.04.2019, in accordance with law and inform the same to the petitioner. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
