THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 836 of 2019 ORDER:

This Contempt Case is filed alleging non-compliance of the order dated 22.04.2019 passed by this Court in Writ Petition No.8432 of 2019.

By the aforesaid order, this Court issued a direction to the respondent authorities to consider the representation to be made by the petitioner with respect to the alleged illegal constructions being made by respondent No.4 therein.

Learned counsel appearing for the respondents submits that on 29.06.2019 itself, intimation was forwarded to the petitioner stating that on receipt of the representation dated 07.05.2019, the authorities had visited the area, but, they could not identify the subject site as they do not have the facility to demarcate the property based on the survey numbers.

It is contended by the learned counsel for the petitioner that the above communication is vague and it is only to escape the contempt, they had issued the aforesaid communication. A perusal of the order passed by this Court in the writ petition discloses that the petitioner had only mentioned that in Survey Nos.62/2 and 62/3 of M.M.Colony, Bandlaguda,

CKR, J C.C.No.836 of 2019 Hyderabad, the fourth respondent is making construction unauthorisedly and illegally, thus, the action needs to be taken. In those circumstances, the stand taken by the respondents that they could not identify the subject property based on the survey numbers cannot be found fault with. However, inasmuch as the representation made by the petitioner stands disposed of, if the petitioner is aggrieved by the same in any manner, it would be open for him to take necessary steps to challenge the same. Accordingly, the Contempt Case is closed.
