HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.13291 of 2019 ORDER:

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing for respondents.

This Court passed order on 02.07.2019 as follows: "It is the case of the petitioner that his cousin i.e., Mamidi Venkateswarlu was convicted in S.C.No.524/2010 under section 302 IPC and sentenced to imprisonment for life by the II Addl.Sessions Judge (FTC), Khammam and that the said conviction was upheld by this Court. While so, on 24.06.2019 the father of said Mamidi Venkateswarlu died at Nelakondapalli Village and Mandal and the said Mamidi Venkateswarlu was released by the 2nd respondent for 48 hours to attend the funeral of his deceased father. The 12th day ceremony of the father of Mamidi Venkateswarlu is scheduled to be held on 04.07.2019 at Nellakondapalli village and an application was made on 28.06.2019 seeking to grant parole to Mamidi Venkateswarlu to attend the obsequies of his father which was forwarded to the 1st respondent. But, till date, no orders are passed. Hence, the petitioner who is cousin of M.Venkateswarlu, filed present writ petition.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home.

Having regard to the aforesaid facts and circumstances, Mamidi Venkateswarlu shall be released on parole on furnishing a bond for Rs.10,000/- executed in favour of 2nd respondent. Mamidi Venkateswarlu again shall surrender before the 2nd respondent on or before 06.07.2019.

Post on 08.07.2019 in Motion List."

Now, it is stated by the learned counsel for the petitioner as well as learned Assistant Government Pleader for Home that the accused, who was released on parole, in pursuance to the aforesaid orders, surrendered before the 2nd respondent.

Recording the aforesaid submission, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
