HON'BLE SRI JUSTICE S.V. BHATT C.R.P.No.2617 OF 2018 ORDER:

Heard Mr.Kasarla Ramesh Reddy and Mr.T.Ramachander Rao for the parties.

Respondents Nos.1 and 2 herein are the plaintiffs. They filed I.A.No.172 of 2017 under Order XXII Rule 4 of CPC to bring on record the revision petitioners herein as defendant Nos. 7 to 9 and respondent Nos. 9 to 13 herein as defendant Nos.10 to 14. The application was allowed. Hence, the revision. The case arises under Order XXII Rule 4 of CPC. The trial Court was satisfied that the proposed defendants in one way of the other do represent the interest of deceased defendant No.4. These prayers are normally well within the jurisdiction of trial Court and in cases where there is absolute illegality or perversity in ordering these applications, this Court in its jurisdiction under Article 227 of the Constitution does not interfere with the orders made by the trial Court.

The revision fails and is, accordingly, dismissed. The learned trial Judge considers disposing of the suit as expeditiously as possible preferably within two months from the date of receipt of a copy of this order. There shall be no order as to costs. Pending miscellaneous petitions, if any, stand closed. ____________ S.V.BHATT, J 30th August, 2018 Lrkm
