Heard learned counsel for the petitioners and the learned Government Pleader for Civil Supplies.
The order of confiscation of the Black Gram stock, passed by the Joint Collector, Kadapa-second respondent herein, vide Ref.No.1(4)/60/2018, dated 22.03.2018, is under challenge in the present Writ Petition.
According to the petitioners they are all agriculturists and residents of Gudipadu Village, Duvvur Mandal, Kadapa District and they own lands in the said village and cultivating the same. It is stated that they raised Black Gram for the second crop season for the year, 2017 and harvested the crop in the last week of February, 2018. It is further stated that, when they brought the said produce to the market yard, the respondentauthorities seized the said stock and resorted to the impugned action. It is further stated that, questioning the action of the respondents in seizing the stock, petitioners herein filed a petition on 09.03.2018 before the second respondent and the second respondent passed the order under challenge. When the matter is taken up, it is submitted by the learned Government Pleader that it is open for the petitioners to submit evidence before the second respondent to show that the
confiscated stock belongs to him and if any such evidence is produced before the second respondent, appropriate action would be taken strictly in accordance with law. In view of the above submission, the Writ Petition is disposed of, keeping it open for the petitioners herein to submit the evidence, in support of their claim, before the second respondent, within a period of one week from the date of receipt of a copy of this order, and, if any such evidence is placed on record by the petitioners before the second respondent, the same be verified and appropriate further action be taken, strictly in accordance with law, within a period of three weeks thereafter. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the Writ Petition, shall stand closed. ___________________ A.V.SESHA SAI,J 11th April, 2018 Note:
