HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.7091 of 2013 ORDER:

This Writ Petition is filed questioning the action of the respondents in attempting to demolish the petitioner's property M.C.No.8-1-207/13/215, admn. 505 sq. yards, situated at TATA Nagar, R.R. District, wherein the petitioner is running business under the name and style as M/s Moiz Food Products, pursuant to notice vide Lr.No.G/48/TPS/C6/GHMC/2013, dated 2.3.2013 as illegal and arbitrary. 2.

The case of the petitioner is that the order under Section 452 (2) of Hyderabad Municipal Corporation Act, 1955 has been issued without giving any details and that it is vague; an application under Section 45%-A of Hyderabad Municipal Corporation Act, 1955 has been filed by the petitioners before the respondents and the respondents may be directed to consider the same.

The Standing Counsel for the respondents submits that the application of the petitioner filed under Section 452-A is pending with them and the respondents will consider and pass appropriate orders in accordance with law. 4.

In view of the submissions made by both the Counsel for the petitioner and the Standing Counsel for the respondents, this Writ Petition is disposed of directing the respondents to consider the application filed by the petitioner under Section 455-A, if it is not yet considered, and pass appropriate orders thereon in accordance with law. 5.
