HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.6789 of 2017 ORDER:
Heard learned counsel for the petitioner/ A2 and learned Public Prosecutor, representing the 1st respondent - State, before ordering notice to the 2nd respondent-de facto complainant of C.C.No.226 of 2015 on the file of the Judicial First Class Magistrate, Pulivendula, where taken cognizance for the offences punishable under Sections 498-A I.P.C. and Sections 3 & 4 of the Dowry Prohibition Act.
Undisputedly, the case is under trial and for this Court there is nothing to interdict, but for, to say all the contentions raised by the petitioner are left open to raise before the trial Court to consider. Needless to say, if at all any requirement of dispense with regular personal appearance of the petitioner being an aged lady under Rule 37 of the Criminal Rules of Practice and the learned Magistrate to consider the same.
Pending miscellaneous petitions, if any, shall stand closed.
