THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.7754 of 2015 ORDER:
This criminal petition is filed under Section 482 Cr.P.C to quash the proceedings in Cr.No.95 of 2015 on the file of Maheshwaram Police Station, Cyberabad, registered for the offences punishable under sections 406, 420 and 506 IPC.
Heard the learned counsel for the petitioner/accused and the learned Additional Public Prosecutor, representing the State. The allegations in brief are that the 2nd respondent/de facto complainant was subscriber of a private chit being run by the
petitioner/accused, pursuant to which he subscribed some amount in the chit and the same was not repaid and in that connection the incident has taken place. On 05.02.2015 it is alleged that when the 2nd respondent/de facto complainant approached the petitioner/accused and asked for his chit amount, the petitioner/accused grew wild and abused the 2nd respondent/de facto complainant in filthy language and threatened him with dire consequences.
The allegations levelled in the complaint, prima facie, reveal the commission of offences, as alleged. This is a matter, which requires investigation by the police. There are no valid grounds to quash the First Information Report.
In the facts and circumstances of the case, it is directed that the investigating agency shall proceed with the investigation, however, shall not arrest the petitioner/accused till the investigation is completed and charge sheet is filed.
The Criminal Petition is accordingly dismissed. Pending miscellaneous applications, if any, shall stand closed in consequence.
