HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.42750 of 2016 O R D E R :

The Writ Petition is filed under Article 226 of the Constitution of India seeking to issue a writ or order, more particularly one in the nature of writ of Mandamus declaring the action of the 2nd respondent in registering the crime No.1117 of 2016, dated 27-11-2016 for the offence under Sections 403, 408 and 420 read with Section 34 I.P.C. against the petitioner basing on the complaint lodged by the 3rd respondent, as illegal and arbitrary. Heard and perused the material available on record. It is informed by the learned counsel for the petitioner that the petitioner is ready to cooperate with the investigation. He further submits that even the petitioner went to the Police Station and requested the Officer concerned to issue notice under Section 41-A Cr.P.C., but, without issuance of the notice under Section 41-A Cr.P.C.

, the 2nd respondent herein intends to arrest the petitioner and harass the petitioner herein. Considering the said facts and circumstances, the Police concerned is directed to complete the investigation without arresting the petitioner and file the final report in accordance with law. The petitioner is directed to execute a personal bond for a sum of Rs.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Consequently, Miscellaneous Petitions pending, if any, in the Writ Petition shall stand closed.
