HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.10595 of 2015 ORDER:
Heard both sides. With the consent of all the parties the main writ petition is being heard at the admission stage itself. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the seniority list published by respondent Nos.1 to 4 dated 24.09.2002 by placing respondent Nos.5 to 18 above the petitioner, as illegal, unjust, arbitrary and violative of Articles 14, 16 and 39-D of the Constitution of India. Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to respondent Nos.1 to 4 to pass orders on the representation dated 17.10.2014 made by the petitioner for his placement at an appropriate place in the seniority list.
Without going into the merits of the case and having regard to the circumstances of the case, the writ petition is disposed of at the admission stage, directing respondent Nos.1 to 4 to dispose of the representation dated 17.10.2014 after hearing the petitioner and respondent Nos.5 to 18 and pass orders in accordance with law, at the earliest, preferably within a period of six (06) weeks from the date of receipt of a copy of the order.
There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
