THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.13421 OF 2017 ORDER:

This Writ Petition is filed, under Article 226 of the Constitution of India, for the following relief: "declaring the action of the 2nd respondent in not finalizing the final bill including interest amount in connection with the work i.e., construction of Archeology Galleries (Shilpalayam) including Internal & External electrification and water supply & Sewerage works at Shilparamam, Hyderabad vide agreement No.14/553/SACCS/SE/Shilpalayam vol - II/ 2013-14/ dt.17-10-2013, inspite of the petitioners representations dt.15-03-2016, 30-12-2016 & 06-03-2017 including not releasing the EMD amount and FSD amount i.e., Fixed Deposit Security after lapse of liability period is illegal and void and opposed to Article 14, 19 & 21 of Constitution of India and consequently to direct the 2nd respondent to consider the petitioners claim and to return the entire amounts in question 2.

Heard learned counsel for the petitioner and learned Government Pleader for respondents.

When the matter is taken up, it is submitted by learned counsel for the petitioner that for redressal of grievance of the petitioner, the petitioner herein submitted a representation to the 2nd respondent on 06.03.2017 finally, apart from other representations filed earlier. A further request is made by learned counsel for the petitioner to direct the 2nd respondent to pass appropriate orders on the said representation within a time frame. 4.

On the other hand, it is submitted by learned Government Pleader that appropriate action would be taken on the representation of the petitioner in accordance with law.

Recording the said submission, the Writ Petition is disposed of, without expressing any opinion on the merits of the case, directing the 2nd respondent to take appropriate action on the representation, dated 06.03.2017, said to have been submitted by the petitioner, in accordance with law, within a period of three (03) months from the date of receipt of a copy of this order.
