HON'BLE SRI JUSTICE SURESH KUMAR KAIT CONTEMPT CASE No.1882 of 2016 ORDER : (Oral) Pursuant to order dated 7th March 2017, respondent No.1 has filed reply to paras 7 and 8 of the counter affidavit filed by the petitioner to the affidavit of the 1st respondent, whereby, stated that Sunnam Raju, P.C.No.1175 was entrusted with service of notice on Donga Kumar S/o. Sri Raghavulu, R/o.Achanta Vemavaram village, the complainant in Crime No.71/2015 under Section 323 IPC, which was posted before the Lok Adalat (Additional JFCM Court), Palakol. In connection with service of notice on the above said person, Sunnam Raju, called the petitioner's father, who is the Village Revenue Assistant of Achanta Vemavaram, on 10.02.2017 at 17:21:18 to find out the whereabouts of Sri Donga Kumar in connection with Crime No.71/2015 under Section 323 IPC. On knowing about the whereabouts of Sri Donga Kumar from the petitioner's father, Sunnam Raju served notice on Sri Donga Kumar, in respect of Lok Adalat case on 10.02.2017.

In the earlier affidavit filed by the 1st respondent, it is stated that there was no phone call made from Mobile No.9704844446 and Mobile No.8374923929 on 10th February 2017 or at any point of time. It is further stated that said phone numbers did not stand in the names of the respective persons and on inquiry, they said that those mobile numbers are on the name of their friends/relatives, however, they are
SKK, J C.C.No.1882 of 2016 using the same mobile numbers. As per the verified call location details of parents of the petitioner, the location of mobile number of father of the petitioner was at Achanta MRO office road near Rangaraya Theatre. However, the mother of the petitioner has no mobile number.

In view of the affidavit filed by the respondent-contemnors, I am of the view that no further order is required to be passed. Therefore, I discharge the respondents from the contempt proceedings. The petition is accordingly disposed of. 4.
I hereby made clear that the directions passed by this Court in the order dated 22.07.2016 in W.P.No.24234 of 2016 shall not be violated in any manner whatsoever by the respondents.
