THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.4178 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioners/ Accused in S.C.No.94 of 2014 on the file of Additional District and Sessions Judge, Vikarabad, Ranga Reddy District, arising out of Crime No.40 of 2013 of Yalal Police Station, Ranga Reddy District, registered for the offences punishable under Sections 147, 452, 323 and 304 read with Section 34 IPC.

Heard the learned counsel for the petitioners and perused the material.

The offences alleged against the petitioners are punishable under Sections 147, 452, 323 and 304 read with Section 34 IPC. Admittedly, after duly investigating into the complaint lodged by the de facto complainant, the Police filed charge sheet against the petitioners A reading of charge sheet also reveals that specific overt acts attributable to the petitioners/accused have been made in the complaint, which, prima facie, made out a case against the petitioners, the truth or otherwise of which can be decided only after due trial. Hence, this Court is not inclined to interfere with the proceedings against the petitioners, and thus, the criminal petition is liable to be dismissed.

Accordingly, the criminal petition is dismissed.

Consequently, miscellaneous petitions pending, if any, shall stand closed.
