THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CIVIL REVISION PETITION No.1885 OF 2016 ORDER:

This civil revision petition is filed by the plaintiffs under Article 227 of the Constitution of India, assailing the order dated 11.2.2016 in C.M.A. No.2 of 2015 on the file of the Court of II Additional District Judge, Parvatipuram, Vizianagaram District. 2.

A perusal of the record reveals that the petitioners filed O.S.No.51 of 2014 on the file of the Court of the Senior Civil Judge, Bobbili, against the respondents for partition of the suit schedule property. Pending suit, the petitioners filed I.A.No.41 of 2014 under Order XXXIX Rules 1 and 2 of CPC. The respondents filed counter opposing the petition. After hearing both sides, the trial Court, by order dated 30.4.2014, granted interim injunction in favour of the petitioners. Aggrieved by the same, the respondents preferred C.M.A.No.2 of 2015, which was allowed by the appellate Court, by the impugned order dated 11.2.2016. Hence, the present civil revision petition is filed by the petitioners. 3.

At the time of arguments, learned counsel for both the parties submitted that the trial Court may be directed to dispose of O.S. No.51 of 2014 as early as possible. In view of the submission made by both the counsel, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case and also the submission made by both the counsel, learned Senior Civil Judge, Bobbili is hereby directed to dispose of O.S.No.51 of 2014

as expeditiously as possible preferably within a period of six months from the date of receipt of a copy of this order. 5.

With the above observation and direction, the civil revision petition is disposed of. Miscellaneous petitions if any pending in this petition shall stand closed.
