O R D E R

The 1st petitioner is the Society, represented by its General Secretary. Its case is that it is promoting the 2nd petitioner - Institute, which is running engineering and technical courses. Its grievance is that by the impugned proceedings dated 14.05.2019, while granting affiliation to the 2nd petitioner - Institute, for the academic year 2019-20, the 1st respondent - University, has reduced the intake of students in B.Tech - CSE branch from 120 to 60, on the ground that Ph.D. qualified faculty is not available. The case of the petitioners is that one faculty Dr.M.V.Brahmananda Reddy, possessing Ph.D. in computers, was very much available, but without considering the same, impugned reduction of seats in computer science branch, has been made.

The further case of the petitioners is that bringing to the notice of the 1st respondent - University, they have made representation on 21.06.2019, but the same has not been considered till date. Hence, the present writ petition. Learned counsel for the petitioner reiterating the above facts, further submit that in similar facts and circumstances a Division Bench of this court in W.P.No.19840 of 2017 dated 19.06.2017, directed the 1st respondent - University to consider the correctness or otherwise of the representation of the petitioner therein, with regard to availability of faculty possessing Ph.D. qualification, and pass orders for granting affiliation for the increased intake of students in the respective branches.

Heard the learned Government Pleader for Higher Education for respondents 2 and 3, Sri A.Abhishak Reddy, learned Standing Counsel

for respondents 1 and 5 and Sri K.Ramakanth Reddy, learned Standing Counsel for respondent No.4.

Having regard to the facts and circumstances of the case, without expressing any opinion on merits, writ petition is disposed of directing the 1st respondent to consider the representation of the petitioners stated to have been made on 21.06.2019, and take appropriate action in accordance with law, within a period of one week from the date of receipt of a copy of this order.

Interlocutory applications pending, if any, shall stand closed. No order as to costs.
