2. Heard both sides. Perused the material on record.

3. Without prejudice to the right of the petitioners claim, stay of any execution in the revision or appeal stated pending against the dismissal order of Order 9 Rule 13 C.P.C, the present CRP proceedings are closed. No order as to costs.

4. Miscellaneous petitions, pending if any, in this Revision shall stand closed.
