ORDER: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed for a mandamus to declare the action of the respondent in issuing the auction sale notice, dated 22.03.2016, fixing the auction date as 23.03.2016, as illegal and arbitrary and consequently, to direct the respondent not to take any coercive steps in respect of open plot admeasuring 982 sq.yds or 821.05 sq.mtrs. in survey No.7(new) 914 (old) situated at Waddepally Revenue Village, Hanamkonda Mandal, Warangal.

2. At the hearing, there is no representation for the petitioners.

3. A perusal of the record shows that as per the time schedule fixed under the impugned auction sale notice, the date for opening of the tenders was '25.03.2016' and the same will be followed by the bid among the tenderers. By the efflux of time, the entire time schedule for opening of the tenders and holding of the bid has already expired. Hence, the cause on which the writ petition is filed is rendered infructuous. This apart, from the absence of their counsel, it is reasonable to presume that the petitioners are not interested in pursuing this litigation.

4. For both the above reasons, the Writ Petition is dismissed.

5. As a sequel to dismissal of the writ petition, W.P.M.P.No.12676 of 2016 filed by the petitioners for interim relief shall stand dismissed as infructuous.
