The Land Acquisition Officer Cum Spl.Deputy Collector v. D.Pullanaik [Died] And 5 ORS

THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE MS JUSTICE J.UMA DEVI LAAS.NOs.438, 736, 769, 888, 909, 1057, 1058 OF 2011 AND 298 OF 2012 COMMON JUDGMENT: {Per the Hon'ble Sri Justice Sanjay Kumar} This batch of appeal is posted before this Court basing upon the letter dated 12.12.2017 addressed by Sri K.Rathanga Pani Reddy, learned counsel for the respondents-claimants, stating that the issues arising for consideration in these appeals are squarely covered by the judgment dated 21.11.2013 passed by this Court in LAAS.No.1 of 2010 and Batch.

The learned Government Pleader for Appeals appearing for the appellant-State would fairly concede this claim of Sri K.Rathanga Pani Reddy, learned counsel. He would however state that in so far as LAAS.No.438 of 2011 is concerned, awarding of compensation for trees did not arise but in so far as the other appeals are concerned, compensation was also awarded for trees on the acquired land. He would further state that in so far as such compensation is concerned, he has no objection to this Court confirming the quantum awarded by the reference Court towards compensation for such trees. As regards the compensation awarded for the various categories of land acquired, he would submit that the judgment dated 21.11.2013 in LAAS.No.1 of 2010 and Batch may be adopted.

Accordingly, for reasons alike as were mentioned in the aforestated common judgment dated 21.11.2013 in LAAS.No.1 of 2010 and Batch and in terms thereof, these appeals are disposed

of reducing the compensation for category No.I lands from Rs.1,90,000/- to Rs.1,70,000/- per acre;

reducing the compensation for category No.II lands from Rs.1,85,000/- to Rs.1,70,000/- per acre; confirming the compensation awarded for category Nos.III and IV lands in terms of the enhancement effected by the reference Court. The compensation awarded by the reference Court for trees shall also stand confirmed. The respondents-claimants would be entitled to all statutory benefits in accordance with law. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
