THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.3377 OF 2015 ORDER:

The petitioner has preferred the present criminal revision case by invoking the provisions under Sections 397 and 401 of Code of Criminal Procedure (Cr.P.C.,) being aggrieved by the order dated 04.12.2015 passed in Crl.M.P.No.184 of 2015 in C.R.P.No.123 of 2015 by the Court of the XIII Additional Sessions Judge, Narasaraopet, whereby the Court below partly allowed directing the second respondent herein to pay two-third of the amount covered under the Crl.M.P.No.1962 of 2015 in M.C.No.26 of 2011 and on such payment, the proceedings in Crl.M.P.No.1962 of 2015 are stayed. Heard and perused the records.

Learned counsel for the petitioner, after arguing for some time, confined his arguments with regard to quantum of amount only. Considering the facts and circumstances of the case, the criminal revision case is disposed of with the following directions. (i) The petitioner herein is directed to pay 50% of the two-third of the amount covered under Cr.M.P.No.1962 of 2015 in M.C.No.26 of 2011, on or before 30.01.2016 to the second respondent; (ii) the petitioner herein is also directed to pay 50% of the interim monthly maintenance ordered in M.C.No.26 of 2011 by the Court below, i.e., Rs.1,750/- (Rupees one thousand and seven hundred fifty only) to the second respondent herein on or before 10th of every succeeding month;

(iii) The petitioner is also directed to pay the arrears of maintenance amount calculating at 50% of the maintenance amount ordered by the Court below, within a period of three months from the date of this order; and (iv) The lower appellate Court is directed to dispose of C.R.P.No.123 of 2015 as expeditiously as possible, preferably within a

period of six months, without being influenced by order of this Court. With the above directions, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions filed in this revision, if any, shall stand closed.
