HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3943 of 2018 ORDER:

This Criminal Petition is filed under Section 482 of Cr.P.C. by the petitioner/A.2 seeking to quash the proceedings against him in C.C.No.168 of 2018 on the file of Special Judicial First Class Magistrate, Erramanzil, Hyderabad.

A perusal of copy of the charge sheet would reveal that the complainant assisted the police of Bahadurpura Police Station in nabbing A.1 in connection with rape case and thereby, A.1 bore grudge against the complaint. Since last two or three months, A.1 used to give false complaint against the complainant to the Commissioner of Police through on line. Further, on the night of 2-11-2017, A.1 to A.3 went on bikes and took away the complainant's brother-in-law Mohd. Ali Shoukath Zohari at about 23.45 hours from Indiana Petrol Pump and asked him to call complainant or else they will kill him. When complainant went to Chintalmet, Accused 1 to 3 threatened him with dire consequences by saying that they will kill him because he helped the police to arrest A.1 in rape case.

Hence, on the complaint lodged by the complainant, the police Bahadurpura registered the case in crime No.230 of 2017 and after investigation, laid charge sheet for the offences under Sections 363 and 506 of I.P.C. Having regard to the prima facie case made in charge sheet, this court finds no reasonable ground to quash the proceedings.

Accordingly, this Criminal Petition is dismissed. As a sequel, miscellaneous applications pending if any, shall stand closed.
