THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.1103 of 2008 ORDER:

The petitioner states that he belongs to Scheduled Tribe category. He was appointed as Junior Lineman on 06.03.1996 and thereafter, he was promoted as Line Inspector by order, dated 10.03.2005. While so, when the second respondent issued order on 04.01.2008 cancelling the earlier order of promoting the petitioner as Line Inspector on the ground of improper application of roster point, the present Writ Petition was filed challenging the order, dated 04.01.2008.

This Court while admitting the Writ Petition on 25.01.2008 granted interim suspension of the said order and the said order was made absolute even after filing of W.V.M.P.No.346 of 2008 by order, dated 26.02.2008. In view of said interim order, the petitioner has been continuing as Line Inspector. In view of continuance of petitioner as Line Inspector by virtue of interim orders since 25.01.2008, the issue relating to grievance of the petitioner need not be decided at this length of time.

Learned counsel for the petitioner is also not in a position to appraise this Court with regard to present position of the petitioner as the petitioner is stated to be not in contact with the counsel. None appears of the respondent also.

In the circumstances, the Writ Petition is closed in view of interim order granted on 25.01.2008 suspending the impugned order, dated 04.01.2008, and making the said interim order as a final order.

Miscellaneous petitions, if any, pending shall stand closed. There shall be no order as to costs.
