THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO. 35145 OF 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader appearing for respondent Nos. 1 to 3. 2.

The prayer sought in the Writ Petition is as under: " ....to issue a writ, order or direction one in the nature of Mandamus declaring the action of the 3rd respondent in threatening the petitioner either to surrender before 2nd respondent or to cause arrest by 3rd respondent in spite of this Hon'ble High Court orders dt. 21.08.2015 in WP.No.26504 of 2015 as being illegal, arbitrary and violative of Art 14 and 21 of Constitution of India."

During the course of hearing, it is brought to the notice of this Court that Government has rejected the representation of the petitioner dated 12.8.2015 for extension of Parole vide Memo No.12069/ legal/ A1/ 2015 dated 24.8.2015 as per Rule 17 of Sentence on Parole Rules, 1981.

In view of the same, no further cause would survive in the Writ Petition and accordingly, the Writ petition is dismissed by placing the said Memo dated 24.8.2015 on record.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
