THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION NO.4748 OF 2015 ORDER:

The petitioner is one of the alumni of Mahatma Gandhi Memorial High School, Hindupur, Anantapuram District.

It is stated that in the memory of the late Head Master of the said school, the alumnis collected funds and built a dais. However, alleging that the present Head Mistress, who is impleaded as fourth respondent, has removed the said dais, complaints were filed by the petitioner and other alimonies.

The petitioner himself has filed a report given by the Head Mistress to the Municipal Commissioner, Hindupur, dated 11.12.2014, stating that in view of the Rastriya Madhyamika Siksha Abhiyan, six new class rooms were sanctioned to the school and in order to accommodate one library room, one laboratory room and computer lab room for the convenience of students and teachers, the said constructions are taken up at the place where the dais originally was constructed. It is also stated that the school has already planned to construct the dais at another place in the school, so that the necessary class rooms, library room as well as dais would co-exist.

In view of the said report of the Head Mistress, I do not think that there is any reason to entertain the Writ Petition. The petitioner appears to have filed the Writ Petition as if he has any legal right over the said dais, which is said to have been constructed by collecting funds. The development of the school and its expansion being paramount in the interests of the students, the Writ Petition is clearly frivolous and more over, since the Head Mistress has already reported that a dais would be constructed at a suitable place, no orders are necessary in this Writ Petition.

The Writ Petition is, accordingly, dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand

dismissed.
