HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.21000 of 2015 ORDER:

Heard the learned counsel for the petitioners. Learned Government Pleader has not received any instructions. However, since the scope of the writ petition is limited, the writ petition is heard and disposed of. The petitioners claim that their father is the absolute owner of the land admeasuring Ac.6-46 cents in Sy.No.51/1 situated at Ganjahalli Village, Gonegandla Mandal, Kurnool District. It is stated that their father gifted the land admeasuring Ac.2-40 cents, Ac.2-06 cents and Ac.2-00 cents respectively to each of the petitioner under a registered gift deed and since then, the petitioners claim to be in possession and enjoyment of the said lands. It is stated that the petitioners have applied for grant of pattadar passbooks and title deeds under Form 6-A but it is stated that no action is taken by the 4th respondent.

The petitioners also issued two legal notices, dated 15-06-2015 and 16-07-2015 to the 4th respondent. The present writ petition is filed questioning the delay and inaction on the part of the 4th respondent in issuing pattadar pass books and title deeds. The documents filed along with the writ petition, however, do not show that the petitioners have applied under Form 6-A as alleged. Therefore, on 09-07-2015, this court directed the learned Government Pleader to get instructions as to whether the petitioners have made application in appropriate proforma. However, in spite of two adjournments, learned Government Pleader is unable to get instructions.

To avoid further delay in consideration of petitioners request for grant of pattadar pass books and title deeds, I deem it appropriate to permit the petitioners to make fresh application for grant of pattadar pass books and title deeds in accordance with the Rules framed under the A.P.

to consider the same on merits and pass appropriate orders within six weeks from the date of receipt of such application. Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
