Heard learned counsel for petitioners and learned Government Pleader for respondent No.1 and Sri N.Praveen Kumar, learned Standing counsel for respondent No.2. 2.
Petitioners claim to be the owners and in possession of house plot admeasuring 410 Square yards in Sy.No.1528/ఉ/1, in Korutla town and Sivar, Korutla Mandal, Jagtial District. Petitioners claim to have purchased the said plot vide registered sale deed dated 06.02.2019. The grievance of the petitioners is against the building permission granted to respondents 3 and 4 in Plot Nos.17 and 16 in Sy.No.1534/A and 1534/B, Prakasham Road Street No.11, Ward No.31. Petitioners contend that the said permission was illegally granted and the land actually belongs to petitioners. Petitioners filed objections before the Municipality. The said objections were considered and by letter dated 29.05.2019 petitioners were informed that on physical verification with reference to boundaries specified in the registered sale deed document, the same are not tallying. Therefore, the objections cannot be sustained. The Commissioner also advised the petitioners to avail appropriate civil law remedy. 3.
This factum of not tallying with the boundary specifications as against what is mentioned in the registered document is not disputed. That being so, I do not see any error, in the decision of Commissioner. Thus, leaving it open to the
- 3 - petitioners to work out their remedies, the Writ Petition is dismissed. Pending miscellaneous petitions, if any, shall stand closed.
