ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for Higher Education, Mr. A. Abhishek Reddy for respondent No.2 and Mr. Deepak Bhattacharjee for respondent No.3

2. Petitioner herein is studying MBA course, having admitted by respondent No.4 institute under SW-II quota. However, admission of the petitioner was not approved by the second respondent herein under the impugned order dated 28.01.2015 on the ground that she was not eligible keeping in view less percentage of marks obtained by her in the qualifying examination.

3. Learned counsel for the petitioner states that the examinations have already commenced from today and seeks liberty to approach the Government seeking condonation of admission in terms of G.O.Rt.No.280 Higher Education (EC.2) Department dated 25.05.2012, as she seeks permission to appear for the balance of the examinations. Reliance is placed upon the orders of this Court considering similar issue in WP.No.14493 of 2012 and batch dated 09.11.2012.

Hence, in terms of the aforesaid order, the petitioner is permitted to make appropriate representation before the first respondent, who shall consider the same and pass appropriate orders within a period of two (2) weeks on receipt of such representation. Subject to the result of such consideration by the first respondent, petitioner may appear for supplementary examination of the first year examinations, as and when held. The writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. _____________________ VILAS V.
