THE HON'BLE SRI JUSTICE U. DURGA PRASAD RAO CRIMINAL PETITION No.7223 OF 2016 ORDER:

The petitioner - accused, who allegedly cheated the complainant on a false promise of marrying her and having sexual intercourse with her several times and got her pregnancy aborted twice, and ultimately absconded and thus, committed offences under Sections 376 and 420 I.P.C., moved the instant bail application under Sections 437 and 439 Cr.P.C.

Heard.

Learned Public Prosecutor would submit that so far six witnesses were examined and investigation is not yet completed.

A perusal of the remand report would show that the accused and complainant were in love for eight years prior to filing of the complaint and the accused by making a false promise of marrying the complainant had sexual intercourse with her several times and aborted her pregnancy twice and ultimately betrayed her. Having regard to the prima facie case and investigation being pending, it is not a fit case to grant bail at this stage.

Accordingly, the petition is dismissed.
