THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.27115 OF 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India for the following relief:
"to issue any appropriate writ, order or direction particularly one in the nature of writ of mandamus, questioning the proceedings of the Respondent No.2 in D.Dis.C2/M/926/2014, dated 17.08.2015 in granting license permitting the Respondent No.5 to exhibit the pictures in its theatre as arbitrary, illegal and contrary to the judgment dated 23.04.2015 in W.P.No.11976/2015 on the file of this Hon'ble Court and consequently set aside the proceedings dated 17.08.2015 as deemed fit and proper in the circumstances of the case and pass such order or other order."
2. According to the petitioner herein, the Joint Collector, passed the impugned order dated 17.08.2015 without considering the objections dated 07.04.2015 submitted by the petitioner herein as directed by this court in W.P.No.11976 of 2015.
3. When the matter is called today, the learned Government Pleader for Home appearing for the respondents has produced the copy of the proceedings bearing reference No.C2(M)/928/2014, dated 17.08.2015, issued by the Joint Collector & Licensing Authority, East Godavari District, Kakinada. A perusal of the said proceedings shows that the Joint Collector rejected the objections filed by the petitioners herein.
4. On noting the same, learned counsel for the petitioner requested this court to give liberty to the petitioner herein to assail the same.
5. In view of the above reasons, writ petition is closed, giving liberty to the petitioner herein to assail the proceedings bearing reference No.C2(M)/928/2014, dated 17.08.2015, in appropriate forum of law.
6. Miscellaneous petitions pending consideration, if any, in the Writ
