HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4788 of 2015 O R D E R:

The petitioners, who are A1 and A2 in Crime No.68 of 2015 on the file of P.S. Hadnoor, Medak District, registered for the offence punishable under Section 506 IPC and Section 3 (1)(x) of the SCs & STs (POA) Act, filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail. Heard and perused the material available on record. Learned Counsel for the petitioners submitted that the petitioners are no way concerned with the alleged offence and there are no serious allegations against them.

There is a bar for granting anticipatory bail in connection with the offence under the SCs & STs (POA) Act. Therefore, this Court is not inclined to grant anticipatory bail to the petitioners. However, the petitioners are at liberty to surrender before the Magistrate/Court below concerned and move an application for bail. On such surrender, the said Magistrate/Court below shall consider the bail application and pass appropriate orders on the same day.
