THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 13555 of 2019 ORDER:
This writ petition is filed challenging the action of the 2nd respondent in calling the petitioners to the police station, frequently, and for a consequential direction to the respondents-police not to threaten the petitioners and his family members and not to interfere with the peaceful possession and enjoyment of the petitioners over their land.
Heard learned counsel for petitioners.
Learned Assistant Government Pleader for Home produced written instructions dt.02.07.2019 produced by Asst.SubInspector of Police, Kotpally P.S., Mancherial District. To the extent of their relevance to the present writ petition, the said instructions read as under:
" It is submitted that the petitioners No.1 to 3 are involved in two cases in Kotpalli Police Station.
1. Crime No.66/2018, under Section 447, 506 IPC of Kotpalli Police Station on 01.07.2018.
2. Crime No.76/2018, under Section 107 Cr.P.C. oc Kotpalli Police Station on 29.07.2018.
It is submitted that the petitioner No.4 is involved in a crime in Kotpalli Police Station.
Crime No.66/2018, under Section 447, 506 IPC of Kotpalli Police Station.
It is respectfully submitted that the allegations made by the petitioners that on 20.06.2019 and 25.06.2019 the police came to their houses and beat them without there being any crime against them is false and denied herewith, as the respondent police never went to the houses of the petitioners not beat them, further it to submit that the above cases are registered against the petitioners in Kotapalli Police Station. It is submitted that the respondent police never called the petitioners to police station nor threatened them and also never interfered with the civil matters of the petitioner." Recording the aforesaid written instructions the writ petition is disposed of directing the respondent police not to interfere with the civil disputes of the petitioners. However this order will not preclude the respondent police from investigating into the above crimes in accordance with law. No order as to costs.
As a sequel, miscellaneous petitions, if any, pending shall stand closed. No order as to costs.
