HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No. 3590 of 2019 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking quashing of the proceedings in C.C.No.9 of 2019 on the file of the XI Metropolitan Magistrate, Ranga Reddy District at L.B.Nagar. 2.

The 1st respondent herein filed a private complaint against the petitioner/ accused for the offence punishable under Section 138 of the Negotiable Instruments Act, 1881.

At the time when the matter is taken up for hearing, learned Counsel appearing for both sides would submit that the trial in the above C.C. has already been commenced, P.Ws.1 and 2 were cross-examined and now the case is coming up for cross-examination of P.W.3. 4.

In view of the above submission, having regard to the facts and circumstances of the case and since the trial in the above C.C. has already been commenced the question of quashing the proceedings in the above C.C. does not arise at this stage.

Accordingly, the Criminal Petition is dismissed. As a sequel thereto, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand dismissed.
