The case of the petitioner is that she is working as Anganwadi Helper, Yerrampalem Village, Rangampeta Project, Gandepalli Mandal, East Godavari District; and that since there is a vacancy for the post of Anganwadi worker in the same centre, the petitioner has submitted representation dated 21.02.2018 to the 3rd respondent, District Collector and the Revenue Divisional Officer. As no action is being taken on the said representation, present writ petition is filed. Learned counsel for the petitioner submits that in fact petitioner is eligible to be promoted in terms of Judgment dated 31374/2015 and batch, dated 16.11.2015, but the respondents have not considered the case of the petitioner.
On the other hand, learned Assistant Government Pleader for Women and Child Welfare basing on written instructions submits that a letter was addressed to the Project Director, DW&CDA, Kakinada, East Godavari District, with a request to appoint enquiry officer to decide the community acceptance for promotion to the petitioner. In the said instructions it is stated that the application of the petitioner was rejected due to absence of Sector Supervisor's remarks and certification for capacity of AWH for rendering the pre-school activities.
It is to be seen that if remarks are not available, the competent authority has to secure the Sector Suprevisor's remarks and certification. It is finally stated in the said instructions that the respondents have sought for appointment of enquiry officer to decide the community acceptance for affecting promotion to the petitioner as per instructions vide Memo No.5771/K3/2006, dated 05.01.2012.
In view of the above, the competent authority is directed to consider the representation of the petitioner and take action by taking into account the facts mentioned in the written instructions submitted by the learned Assistant Government Pleader for Women and Child Welfare.
Accordingly, the writ petition is disposed of. No order as to costs.
