THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.14219 of 2015 ORDER:

This Criminal Petition is filed by the petitioner-accused under Section 438 Cr.P.C. seeking to grant anticipatory bail to him in Crime No.218 of 2014 on the file of Konijerla Police Station, Khammam District, registered for the offence punishable under Sections 294(b) of IPC and Section 3 (1)(x) of SCs & STs (POA) Act. Heard and perused the material available on record. It is alleged that the petitioner abused the de facto complainant in the name of his caste on the ground that the calf of the de facto complainant damaged the fields of the petitioner. Learned Counsel for the petitioner submitted that the present complaint was lodged after lapse of 16 days.

There is a bar for grant of bail in the case registered for the offence under Section 3 (1) of the SCs & STs (POA) Act. Hence, this Court is not inclined to grant anticipatory bail to the petitioner. However, considering the facts and circumstances of the case, this Court is inclined to pass the following order: The petitioner-accused is directed to surrender before the Court concerned and file an application for regular bail. On such application being filed, the Court concerned shall consider the same on the same day.
