HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3951 of 2018 ORDER:

This Criminal Petition is filed under Section 482 of Cr.P.C. by the petitioner/A.8 seeking to quash the proceedings against him in Cr.No.194 of 2017 of Proddutur II Town Police Station, YSR Kadapa District.

The petitioner/A.8 was not initially shown as accused in the F.I.R. However, in the Remand Report dated 27-3-2018, the Investigating Officer mentioned that on 29-4-2011, Shakeer, A.8 and Shabriya called A.1 to Proddutur Sub-Registrar Office and got prepared a document by distributing the Ac.7 1⁄2 cents of land among themselves and got prepared the registered document to that effect vide document Nos.5333/2011, 5335/2011 and 5334/2011 dated 29-4-2011 and thus, the accused colluded with each other and committed forgery and cheating.

Investigation is reported to be pending.

Learned counsel for the petitioner/A.8 would submit that so far as A.2 to A.4 are concerned in Crl.P.No.1156 of 2018, this court passed an order directing the Station House Officer not to arrest them and complete investigation.

The petitioner/A.8 also stands more or less in the same footing. In that view of the matter, the Investigating Officer can continue investigation but of course, without arresting the petitioner/A.8.

This Criminal Petition is disposed of accordingly. As a sequel, miscellaneous applications pending if any, shall stand closed.
