O R D E R

The prayer of the petitioner in this case was as under: "For the reasons stated in the accompanying affidavit and those that are to be urged at the time of hearing it is prayed that this Hon'ble Court may be pleased to issue Writ or order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents in not sanctioning and releasing the Ex-gratia amount and also Gallantry Award Allowance inspite of issuing Gallantry Award is illegal, arbitrary and violative of Articles 14 and 16 of the Constitution of India and consequently direct the Respondents to Sanction and Release Ex-gratia amount and Gallantry Award Allowance and pass such other or further orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

By interim order dated 14.08.2007, this Court directed the respondents to consider the case of the petitioner for release of Ex-gratia amount and Gallantry Award allowance within a timeframe and communicate a copy of the order passed in that regard.

It is now represented that order dated 26.011.2007 was passed by the Directorate General, Central Industrial Security Force, Ministry of Home Affairs, Government of India, stating that the request for monetary allowance attached to the medal could not be approved on the ground of the petitioner's entitlement. In that view of the matter, the grievance of the petitioner now, if any, has to be in relation to the subsequent order and as

the same is not under challenge before this Court in the present writ petition, no adjudication is required.

The writ petition is accordingly closed leaving it open to the petitioner to take appropriate steps with regard to his subsequent grievance, if any, in accordance with law.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
